Legal and Deposition Fees Policy

As a function of his/her position in the Department of Neurology, a physician is sometimes requested or required to render an expert opinion for legal purposes. The policy of the Department of Neurology regarding fees and payments for faculty expert opinions is as follows:

Patients examined and/or treated in departmental facilities are considered patients of the department and all income derived from services (including legal opinions) provided to these patients are considered departmental income and should be forwarded to the business office.

If an expert opinion is given on a patient who has not been treated in the department, the faculty may retain the income for his/her personal use. If a faculty member gives more than three opinions during any academic year, the department chairman should be notified. The University’s professional liability program is not required to provide protection in the event of a service that results in a malpractice claim unless the fee from such service is turned into the department and considered as professional income.


FEES

Deposition on premises

1st hour or portion thereof – $1,500

Record review on premises

1st hour or portion thereof – $750

Court Appearance

Minimum fee (plus expenses) – $2,500

Appointments canceled with less than 72 hours notice will be subject to a fee of $100.

Fee for services requiring more than one hour/day should be prorated based on the rates listed above (example: Deposition requiring 1.5 hours – fee $2,250).
